Former President Benigno “Noynoy” Aquino III has requested the Office of the Ombudsman to dismiss the charges it meant to file in opposition to him earlier than the Sandiganbayan over his legal responsibility within the 2015 Mamasapano bloodbath.
Aquino filed a movement for reconsideration which requested the Ombudsman to overturn its July 14 decision which discovered possible trigger to indict him, former Philippine National Police (PNP) Director General Alan Purisima and former Special Action Force (SAF) Director Getulio Napeñas with graft and usurpation of authority.
“To reiterate, Respondent Purisima’s involvement as a mere resource person and his act of forwarding to me the messages of Respondent Napeñas cannot be construed as discharging official functions and thereby violating the order of preventive suspension,” Aquino identified in his movement.
Also, Aquino accused the Ombudsman disregarding and violating “his constitutionally protected right to be informed of the nature or cause of accusation against me.”
He identified “the assailed resolution charges me with offenses that are totally separate, distinct and different from the charges leveled against me in the consolidated complaints.”
In her decision, Ombudsman Conchita Carpio Morales mentioned “there is no gainsaying that President Aquino was fully aware that the Office of the Ombudsman had placed Purisima under preventive suspension at that time [for the anomalous Werfest deal].”
There have been 44 SAF members have been killed whereas conducting Oplan Oxodus which was meant to seize wished international terrorist, Zulkifli Bin Hir alias “Marwan” and Ahmad Akmad Uson in Mamasapano, Maguindanao.
