Solicitor General Jose Calida on Monday (May eight) lauded the choice of the Court of Appeals (CA) 12th Devision to acquit alleged pork barrel rip-off mastermind Janet Lim Napoles from her critical unlawful detention charge.
“I commend the magistrates of the 12thDivision of the Court of Appeals for doing what is right based on the evidence before them,” he mentioned in an announcement.
In acquitting Napoles, the CA 12th Division reversed the April 14, 2015 ruling of the Makati City Regional Trial Court (RTC) Branch 150 whereby she was discovered responsible of critical unlawful detention in reference to detained pork barrel rip-off whistleblower Benhur Luy.
Before the discharge of the choice, the Office of the Solicitor General (OSG) filed in January a manifestation saying the proof introduced by the prosecution didn’t assist the conviction “beyond reasonable doubt” of Napoles.
“The evidence in the Napoles case did not sustain the conviction of the trial court,” Calida mentioned.
“The essential element of deprivation of liberty was absent and wanting in this case,” he added.
