Solicitor General Jose Calida believes the Supreme Court (SC) will stand pat in supporting President Rodrigo Duterte’s Proclamation No. 216 which declared martial law and suspended habeas corpus over Mindanao.
“With the supermajority votes of the [Supreme Court] justices declaring Proclamation No. 216 as constitutional, meaning, there is sufficient factual basis for the imposition of martial law in Mindanao, my fearless forecast is that petitioners have two chances: nil and none,” Calida informed GMA News Online Tuesday (July 11).
Calida responded to the plans of petitioners together with opposition lawmakers led by Albay Rep. Edcel Lagman to file an enchantment to the choice of the SC to help Proclamation No. 216.
Last July four, 11 justices of the 15-member SC voted to help the proclamation.
Only Justice Marvic Leonen voted to grant the petitions to nullify Proclamation No. 216.
While, three justice voted to partially grant the petitions and restrict the areas the place martial law ought to be declared. They are Chief Justice Ma. Loudes Sereno and Justices Antonio Carpio and Alfredo Benjamin Caguioa.
