Senate Minority Leader Franklin Drilon has referred to as on fellow senators to condemn the choice of the Department of Justice (DOJ) to downgrade to murder from homicide the charges slapped in opposition to rating police officers accused of killing Albuera Mayor Rolando Espinosa Sr.

Such transfer, he stated, was an insult to the Senate that beneficial, following an inquiry into the stated incident, the submitting of homicide charges in opposition to Criminal Investigation and Detection Group (CIDG) Region eight chief Supt. Marvin Marcos and 18 different policemen and extra importantly, a big blow to the nation’s justice system.

Drilon recalled that Justice Secretary Vitaliano Aguirre II himself, certified in one of many Senate hearings the killing of Espinosa as a “premeditated killing.” Aguirre likewise labeled the operation led by Marcos as an “overkill” as 19 of his males have been out to serve a search warrant for a single weapon alleged to be in possession of the late mayor inside his detention cell.

Aguirre even stated that solely three or 4 individuals may have achieved the job, he stated.

“He even pointed out that the conduct of Espinosa’s arrest was not consistent with the PNP’s procedures,” Drilon stated noting Aguirre’s assertion on the serving of the stated warrant as being below uncommon circumstances because it was achieved at four:30 AM when searches would normally be performed throughout daytime.

“It begs now the question: Why did the DOJ suddenly reverse its earlier decision, which was supported by ample evidence? Why not allow the court to determine if it’s murder or homicide?” he requested.

The motion taken by the DOJ would solely gasoline speculations and fears of a rising police impunity in the nation, Drilon stated.

“I agree with Sen. (Panfilo) Lacson that the Senate should denounce this maneuvering of the DOJ. Otherwise, no one would believe any investigation that the Senate will be conducting in the future,” he added.
