The Senate minority bloc has formally moved to have the higher chamber examine why their suggestions to pursue murder charges towards the alleged killers of Albuera, Leyte Mayor Rolando Espinosa Sr. had been ignored.
“The downgrading of the criminal charges against the officers of Criminal Investigation and Detection Group-Region 8 (CIDG-8) fuels fears of a growing police impunity in the country and sends a disturbing message that law enforcers are exempt from the rule of law and that abuses committed by policemen – purportedly in the course of their official duties – will be tolerated and the Constitutional guarantees of due process and the right to life, liberty and property may be ignored,” they stated in submitting decision No. 417.
Minority Leader Franklin Drilon together with Senators Francis “Kiko” Pangilinan, Risa Hontiveros, Bam Aquino, Antonio Trillanes IV, together with detained Sen. Leila de Lima expressed their grave concern over the choice of the Department of Justice (DOJ) to downgrade to murder even when there’s no new proof or compelling motive for the company to reverse its unique findings.
The Senate, on March 15, unanimously authorised and adopted Committee report No. 46, the findings of the joint probe of the committees on public order and harmful medicine and justice and human rights, concluding that the killing of Espinosa was premeditated and with abuse of authority on the half of the operatives of CIDG-eight
While the data for murder was already pending earlier than the Regional Trial Court (RTC) of Baybay, Leyte Branch 14, the DOJ reversed its earlier decision and accordingly dismissed the murder charges towards the accused and indicted them as a substitute for the lesser and bailable offense of murder.
The RTC consequently granted the movement of the DOJ, amending the charges from murder to murder and subsequently allowed the discharge on bail of principal suspect Supt. Marvin Marcos and 18 different co-accused.
Consistent with the obligation of the Senate to examine on the opposite branches of authorities, the minority senators sought to direct the suitable higher chamber committee to inquire, in assist of laws, why the suggestions of the Senate had been ignored with the tip view of formulating remedial or corrective laws
