Solicitor General Jose Calida on Monday, June 19, has requested the Supreme Court (SC) to drop the identify of President Rodrigo Duterte as a respondent in the petitions searching for the nullification of martial law declared over Mindanao.

“Petitioners cannot be permitted to disregard the doctrine of presidential immunity,” learn his memorandum filed earlier than the SC on Monday (June 19).

“Without any waiver of his immunity from suit, President Duterte should be dropped as a party-respondent,” he identified.

Calida reminded the excessive tribunal that it has repeatedly dominated the President “may not be sued in any civil or criminal case, and there is no need to provide for it in the Constitution or law.”
