Sen. Francis Escudero warned that BPI depositors who took benefit of the glitch within the financial institution’s system and withdrew the cash unintentionally credited to them may face civil legal responsibility for “unjust enrichment.”

The senator made the comment amid reviews of “unauthorized transactions” monitored by BPI.

“At maliwanag may nagsamantala sa ilang depositors. Ang pagkakamaling iyon, base sa Civil Code ay ‘unjust enrichment’ na itinuturing,” Escudero stated in a media discussion board.

Escudero added, “Ibig sabihin hindi naman talaga sa iyo ‘yan. hindi mo p’wedeng pakinabangan (ang perang ‘yan) porket nagkamali ‘yung bangko.”

Pressed whether or not it’s nonetheless secure to keep up a financial institution deposit, he stated, “Definitely. Mas magada pa nga security features ng ating mga bangko rito kaysa sa ibang bansa.”
